“Bangladesh Approves Death Penalty for Enforced Disappearances”

The draft of the “Enforced Disappearance Prevention and Redress Ordinance 2025” has received final approval from the Advisory Council of the interim government. This ordinance includes the provision of imposing the death penalty as the highest form of punishment for proven cases of enforced disappearance.

The approval was granted during the 47th meeting of the Advisory Council, which was chaired by Chief Adviser Prof Muhammad Yunus at his office. Following the meeting, Chief Adviser’s Press Secretary Shafiqul Alam briefed reporters at the Foreign Service Academy in Dhaka.

Shafiqul Alam mentioned that the draft law contains stringent penalties, including capital punishment, for individuals convicted of enforced disappearance. He stated that the law ministry will release more detailed information in the near future when asked about other penalties under the proposed law.

Regarding provisions for the victims’ families, Shafiqul Alam confirmed the establishment of a fund for providing compensation. Additionally, he highlighted that the National Human Rights Commission will be responsible for investigating allegations of state agency involvement in enforced disappearances.

In response to inquiries, the press secretary stated that the ordinance includes the creation of special tribunals, aiming to conclude trials within 120 days of charges being framed. The rights of victims, informants, and witnesses will be protected, and measures will be in place to ensure compensation and legal aid.

Shafiqul Alam expressed optimism that future generations in Bangladesh will not experience enforced disappearances, emphasizing the prevention of such crimes. He stated, “The court will determine the feasibility of completing trials within 120 days. However, we have faith that enforced disappearances will not recur in Bangladesh, by the will of God. We hope that no one will commit such crimes in the future.”
